1. Introduction

1.1 Overview
Welcome to Esimster (the “Website”), a service operated by NEXGEN FINANCETECH LTD
(Company No. 15460717), incorporated in England & Wales with its principal place of business at 85 Great Portland Street, First Floor, London, W1W 7LT (“Company”, “Esimster”, “we”, “us” or “our”). These Terms & Conditions (“T&C”) govern your access to the Website, the purchase and activation of eSIM products, and all related services (collectively, the “Services”).

1.2 Acceptance
By accessing the Website, creating an account, purchasing or activating any eSIM, you (“User”, “you”) confirm that you have read, understood, and agree to be legally bound by these T&C. If you disagree with any part of the T&C, do not use the Website or Services 

1.3 Governing Framework
These T&C are governed by the laws of England & Wales, including (where applicable) the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 (“CCR 2013”), the UK General Data Protection Regulation (“UK GDPR”), and other mandatory statutory provisions.


2. Definitions

  • End User – an individual purchasing eSIM products primarily for personal use.
  • Business Usera company or individual purchasing on behalf of a business or for
    commercial purposes.
  • eSIM / Service(s) – any digital SIM, data plan, feature, content or offering made available by Esimster.
  • Website https://esimster.com and any sub-domains.
  • Payment Processor –  aPCI DSS compliant third-party provider that processes card
    or alternative payments on our behalf.
  • User-Generated Content (“UGC”) – any reviews, comments, feedback, or materials
    submitted by Users on or via the Website.

3. Scope of these T&C

3.1 These T&C apply to all Users (End and Business). Additional terms may apply to specific
promotions, vouchers or ancillary services and will prevail in case of conflict

3.2 Our handling of personal data is set out in the Privacy Policy, which forms part of these T&C. 


4. Eligibility and User Warranties

4.1 Age & Capacity – You confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract.
4.2 Accuracy of Information – You warrant that all information provided to Esimster is true, accurate and current and that you will promptly update it when necessary.
4.3 Legal Use – You agree not to use the Services for any unlawful, fraudulent or unauthorised purpose and to comply with all applicable laws and regulations.


5. Prohibited Activities

You must not:

  1. Engage in payment fraud, identity theft, unauthorised resale of eSIMs, or other illegal acts;
    2. Intercept or interfere with any network, data or system of Esimster or its partners;
    3. Distribute malware, spam or phishing content via the Services;
    4. Infringe intellectual-property or privacy rights of Esimster or third parties;
    5. Bypass, disable or otherwise interfere with the security or usage rules of the Website or eSIM services.

Violation may result in immediate suspension or termination of your account and potential legal action. 


6. eSIM Use and Activation

6.1 Device Compatibility – It is your responsibility to verify that your device is eSIM-capable and unlocked. Compatibility lists are provided on the Website as guidance only. 

6.2 Service Availability – Connectivity depends on third-party mobile network operators. Esimster is not liable for outages, speed reductions, or roaming restrictions outside our control.

6.3 Validity & Limits – Each eSIM plan has defined data allowances, geographic scope and validity periods. Unused data expires at the end of the validity period and is not rolled over or refunded.


7. Payment Terms

7.1 Accepted Methods – Payments are processed by PCI DSS-compliant payment processors. Accepted methods are displayed at checkout (e.g., Visa, Mastercard). Esimster does not store card details.
7.2 Prices & Currency – Prices appear in GBP unless stated otherwise. Your issuer may apply exchange-rate conversions or fees for cross-border transactions. Esimster is not responsible for such charges.
7.3 Taxes – Prices include UK VAT where applicable. If you are outside the UK or purchasing as a business, you are responsible for any import duties, local VAT or withholding taxes as required by your jurisdiction.


8. Refund Policy

Purpose: Because eSIM profiles constitute digital content supplied immediately on activation, refund rights are necessarily limited. This section sets out the only circumstances under which any refund, credit or replacement may be granted. All other situations are expressly excluded.

8.1 Statutory Cooling-Off (End Users)
Under the Consumer Contracts Regulations 2013 (CCR 2013) you may cancel an un-activated eSIM within 14 calendar days of purchase.
• If you choose to download or install the eSIM during this period, you explicitly waive the statutory right to cancel once activation starts.
• Business Users do not benefit from this cooling-off right.
8.2 No Refund After Activation
Once an eSIM is installed, scanned, provisioned or otherwise activated on any device, no refund, exchange or credit will be provided, except where mandated by law or explicitly stated in 8.3 below.
8.3 Technical Failure Caused by Esimster
A one-time replacement eSIM may (at our sole discretion) be issued only if all of the following are satisfied:
1. You notify us at [email protected] within 48 hours of purchase;
2. You provide full diagnostic evidence (order ID, IMEI, device screenshots, error logs, date/time of attempts);
3. Our support team confirms that the fault is reproducible and attributable solely to Esimster or its carrier partner;
4. You cooperate in all troubleshooting steps we request.
If the fault is validated and cannot be remedied within 10 calendar days, we will either (a) provide a replacement profile of equal value or (b) issue a refund to the original payment method. Partial refunds are not offered.

8.4 Strictly Non-Refundable Circumstances
Activation on an incompatible, locked, or roaming-restricted device;
Network congestion, latency, throttling, or outages attributable to third-party carriers;
Expiry of unused data or validity period;
Purchases older than 14 days;
Fraud, chargeback attempts, resale or breach of these T&C;
Third-party expenses (handset repair, hotel Wi-Fi, VPN subscriptions, etc.).
8.5 Unauthorised Transactions
Claims of unauthorised use must be raised within 7 calendar days of the transaction. We may require a police report or bank confirmation. If investigation shows no compromise, the refund will be refused.
8.6 Administrative Fee
Approved discretionary refunds (i.e., those not required under CCR 2013) are subject to an administrative fee of £10 (or equivalent), deducted from the refund amount.
8.7 Procedure & Timeframes
1. Submit Request – Email [email protected] with full evidence as outlined above.
2. Initial Review – We aim to acknowledge within 2 business days.
3. Decision – Final determination is made within 10 business days; our decision is final and binding.
4. Payout – If approved, funds are returned to the original payment method within 1- 7 business days (subject to card scheme processing).
8.8 Third-Party & Reseller Purchases
If you bought an eSIM via any marketplace, travel platform or physical reseller, their refund policy applies. Esimster will not process refunds for third-party sales.


9. Gift Vouchers and Promotions

Gift vouchers are redeemable only on the Website, non-transferable, non-refundable (except as required by law) and expire on the date shown at purchase. Promotional codes cannot be combined unless expressly stated.


10. End Users vs Business Users

10.1 End Users enjoy statutory consumer rights under UK law. Where provisions of these T&C conflict with mandatory consumer legislation, such legislation prevails.
10.2 Business Users waive consumer rights that do not apply to business-to-business contracts. Business Users confirm they act in the course of trade or profession


11. Disclaimers of Warranties

The Services are provided “as is” and “as available”. Except as required by UK law, Esimster disclaims all warranties, express or implied, including merchantability, non-infringement and fitness for purpose. We do not warrant uninterrupted or error-free service.


12. Limitation of Liability

12.1 Cap – To the extent permitted by law, Esimster total liability (whether in contract, tort or otherwise) shall not exceed the amount paid by you for the Service giving rise to the claim.
12.2 Exclusion – Esimster shall not be liable for indirect or consequential losses, including loss of profit, data or business opportunities, except where such exclusion is prohibited by law.
12.3 Non-Excludable Liability – Nothing in these T&C limits or excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.


13. User-Generated Content

By submitting UGC, you grant Esimster a worldwide, perpetual, royalty-free,
sub-licensable licence to use, reproduce and display such content. You warrant that your
UGC does not infringe third-party rights. We may remove any UGC at our discretion.


14. Service Management

We may monitor usage, suspend accounts, throttle data or take other measures to enforce these T&C, protect network integrity, or comply with legal obligations.


15. Modifications and Interruptions

We may modify or discontinue Services and prices at any time. We aim to provide advance notice of significant changes but are not liable for resulting damages.


16. Termination and Suspension

Esimster may suspend or terminate your access for breach of these T&C, suspected fraud, non-payment, or legal requirement. Upon termination you lose access to active eSIMs; no refunds will be issued except under Section 8.


17. Dispute Resolution and Governing Law

17.1 These T&C are governed by the laws of England & Wales.
17.2 The courts of England & Wales have exclusive jurisdiction over any dispute, unless you are an EU consumer and choose local courts under EU Regulation 1215/2012.
17.3 Alternative Dispute Resolution (ADR): You may use the UK Online Dispute Resolution platform (odr. europa.eu) or another certified ADR entity before commencing court proceedings.

19. Privacy & Cookie Policies

Personal data is processed in line with our Privacy Policy and Cookie Policy, which form part of these T&C.


20. Final Provisions

20.1 Changes – We may update these T&C; updated versions take effect when posted. Material changes will be notified by email or Website banner.
20.2 Severability – If any provision is held invalid, the remaining provisions remain in force.
20.3 Entire Agreement – These T&C plus referenced policies constitute the entire agreement between you and Esimster.
